Welcome to Fintura. These Terms of Service ("Terms") govern your access to and use of the Fintura platform and services provided by Fintura Ltd (Company Number: 15782774), a company registered in England and Wales with its registered address at 71-75 Shelton Street, London, England, WC2H 9JQ, United Kingdom ("Fintura", "we", "our", or "us").
By accessing or using the Fintura platform ("Platform"), you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Platform.
1. Description of Services
Fintura is a web-based platform offering an all-in-one accounting solution for accountants in South Africa. The Platform includes features covering nine core finance functions, AI-driven tools including our AI Fractional Advisor "Hank," and integrations with statutory bodies such as CIPC, SARS, and the Department of Labour.
2. Account Registration
To use Fintura, users must create an account. You agree to provide accurate, current, and complete information and to keep this information up to date. You are responsible for maintaining the confidentiality of your account and password.
3. Subscription and Payment
Fintura offers both monthly and annual subscription plans, as well as pay-per-service options for specific modules. All payments are processed securely through Stripe. Users are entitled to a 30-day free trial. If a user upgrades during the trial, the remaining trial balance will be applied as a credit.
Prices and available services may change, and we will provide notice of changes where required.
4. Data Submission and Authorisation
By using Fintura, you authorise us to collect and process your data, including personal, company, and financial records, and submit such data to third-party statutory bodies (e.g., CIPC, SARS, DOL) on your behalf, where explicitly permitted by you. You retain responsibility for ensuring the accuracy and legality of all data submitted through the Platform.
5. User Conduct
You agree not to:
- Use the Platform for unlawful or fraudulent purposes.
- Interfere with or disrupt the Platform or servers.
- Upload or share material that is harmful, offensive, or infringes intellectual property rights.
6. AI Assistant "Hank"
Hank, the AI Assistant, is provided for informational support only. While efforts are made to provide accurate and relevant responses, Hank’s output should not be considered a substitute for professional accounting or legal advice. Hank may collect usage data to enhance functionality.
7. Termination
We reserve the right to suspend or terminate access to the Platform for any user who violates these Terms or engages in any activity that may harm Fintura or other users.
8. Data and Intellectual Property
All intellectual property on the Platform, including code, trademarks, and content, belongs to Fintura or its licensors. Users retain rights to their uploaded data but grant Fintura a license to use such data for service provision, subject to the Privacy Policy.
9. Limitation of Liability
To the fullest extent permitted by law, Fintura shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the Platform. Our total liability shall not exceed the amount paid by you to use the Platform in the twelve months preceding the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising from these Terms shall be resolved in South African courts.
11. Amendments
Fintura may update these Terms from time to time. We will notify users of any material changes and your continued use of the Platform will constitute acceptance of the updated Terms.
